Terms of Service

These Terms of Service govern all services provided by Marc Heiduk (sole proprietorship), Stolberggasse 1-3/49, 1050 Vienna, Austria (hereinafter "Operator") to therapists (hereinafter "Therapist" or "User").

Therapists within the meaning of these Terms are exclusively persons holding an Austrian or European psychotherapy, clinical psychology, health psychology, or equivalent healthcare professional qualification, who offer their services on the platform. Use of the platform by consumers (client search) is subject to separate terms of use.

Any terms and conditions of the Therapist that deviate from these Terms shall not be recognised unless the Operator has expressly agreed to them in writing.

Platform: Therapeutensuche.at is a bilingual (German/English) online directory for Austria that helps people find therapists. The Operator provides Therapists with the technical infrastructure to create and manage a publicly visible profile.

No employment relationship: Use of the platform does not create an employment, service, or agency relationship between the Operator and the Therapist.

No treatment brokerage: The Operator does not broker treatment engagements and is not liable for the establishment, content, or conduct of therapeutic relationships.

Registration requires the creation of a user account with a valid email address and the provision of complete profile data (first name, last name, professional qualification, practice address).

After registration is completed, the profile is reviewed by the Operator (manual approval). The Operator reserves the right to reject registrations without stating reasons, in particular where no verifiable professional qualification is on record.

The Therapist is responsible for the accuracy and currency of their profile information. Inaccurate information, in particular regarding qualifications or health insurance authorisation, entitles the Operator to immediately deactivate or delete the profile.

Each natural person may only create one account.

The Operator offers the following service plans:

The Operator reserves the right to adjust the scope of either plan. Existing Premium subscriptions will only be affected by reductions after the end of the paid term; enhancements take effect immediately.

Current prices (VAT inclusive):

All prices are gross prices inclusive of statutory value added tax. For users outside Austria the applicable tax rate may differ; the platform collects tax automatically based on the billing country.

Payment: Billing is processed through Stripe Payments Europe, Ltd. Accepted payment methods are credit cards and other methods offered by Stripe.

Automatic renewal: Monthly subscriptions renew automatically for one month at a time; annual subscriptions renew for their original term, unless cancelled in due time (§ 6).

Price changes: The Operator may announce price changes with 30 days' notice by email. Increases take effect from the next billing period. In the event of a price increase the Therapist has the right to terminate the subscription by the end of the current period.

Free Plan: The Free Plan is provided free of charge and runs for an indefinite period. It may be terminated at any time by deleting the account (§ 9).

Premium subscription: The subscription begins upon completion of the checkout process and runs for the selected term. It renews automatically (§ 5 para. 3).

Ordinary termination: Termination is possible at any time via the user dashboard or by email to office@therapeutensuche.at. Termination takes effect at the end of the current billing period; until then access to Premium features remains active.

Extraordinary termination: The Operator may terminate the subscription and/or the account with immediate effect if:

• the Therapist has provided false information regarding their qualifications,
• these Terms have been breached,
• payment arrears remain outstanding despite a payment reminder,
• regulatory requirements or legal reasons so require.

In the event of extraordinary termination by the Operator due to fault of the Therapist, no refund of amounts already paid shall be due.

The Operator grants a voluntary 14-day money-back guarantee on the first Premium subscription, starting from the day of activation.

A full refund of the amount paid will be issued upon request by email to office@therapeutensuche.at, without requiring reasons, provided the request is received within 14 days of activation.

The guarantee applies exclusively to the first subscription. No refund is available for renewals, plan changes, or new subscriptions taken out after a prior cancellation.

The Therapist is obliged to:

• provide only truthful and complete information,
• keep their qualification and any health insurance authorisation up to date,
• promptly deactivate or delete their profile upon ceasing therapeutic practice or in the event of incapacity to work,
• not upload content that infringes third-party rights (copyright, personality rights),
• not make misleading or anti-competitive statements.

The Therapist is responsible for all actions carried out via their account and must keep their login credentials secure.

Reselling or transferring the account to third parties is not permitted.

The Therapist may delete their account at any time via the dashboard.

Following account deletion, data is retained for 30 days (deletion hold period). During this period the account may be reactivated upon request.

After 30 days all personal data is irreversibly deleted, including profile photos, biography, and profile information. Active subscriptions are cancelled immediately; no refund is due for remaining subscription periods.

Statutory retention obligations (e.g. accounting records under the Austrian Commercial Code, 7 years) are not affected by the data deletion.

The Therapist may request a data export (all personal data in machine-readable format) from the dashboard at any time.

For the duration of the contractual relationship the Therapist grants the Operator a non-exclusive, worldwide licence to store, display, and use uploaded content (texts, photos, profile information) for the purpose of operating the platform, and in anonymised form for SEO purposes.

This licence expires upon deletion of the relevant content by the Therapist or, at the latest, upon complete account deletion (§ 9 para. 3).

The Therapist warrants that they hold all necessary rights to the uploaded content and indemnifies the Operator against any third-party claims.

The Operator is liable without limitation for damages arising from injury to life, body, or health, and for gross negligence and wilful misconduct.

For ordinary negligence the Operator is liable only where essential contractual obligations (cardinal duties) have been breached, and only up to the amount of fees actually paid in the preceding month.

The Operator accepts no liability for:

• the completeness, accuracy, or currency of content posted by Therapists,
• the establishment or quality of therapeutic treatments,
• temporary unavailability of the platform (maintenance, technical disruptions),
• acts or omissions of Stripe as payment service provider.

Platform availability of 99% per year (measured outside announced maintenance windows) is the target but is not guaranteed.

Personal data is processed in accordance with the platform's Privacy Policy and the General Data Protection Regulation (GDPR). The Therapist is themselves the data controller within the meaning of the GDPR with respect to their clients' data; the Operator is not a data processor in this regard.

The Operator reserves the right to amend these Terms with 30 days' notice by email. Amendments are deemed approved if the Therapist does not object in writing within 14 days of receiving the amendment notice.

In the event of an objection the contract ends when the amended Terms take effect; until then the previous version continues to apply. Amounts already paid for periods after the contract end will be refunded on a pro-rata basis.

Governing law: Austrian law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules.

Jurisdiction: For contracts with business users, the exclusive place of jurisdiction is the registered seat of the Operator, Vienna. Mandatory statutory places of jurisdiction remain unaffected.

Severability: Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that most closely achieves the economic purpose of the invalid one.

Alternative dispute resolution: The Operator is willing to participate in dispute resolution proceedings before the Internet Ombudsman conciliation body (www.ombudsmann.at).
